These Terms and Conditions (“Terms”) apply to your use of the Walky Talky mobile application, website, and related services (collectively, the “Services”). By accessing, browsing, downloading, or using any of the Services, you agree to be bound by these Terms.

1. About the App

Walky Talky is a free mobile application offering audio content such as walking tours, and location-based audio experiences for personal, non-commercial use.

The App is operated from the Netherlands.

Walky Talky also operates a promotional website that provides information about the App and related services. These Terms apply to both the App and the website where applicable.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you confirm that you meet this requirement.

3. Use of the App

You agree to:

  • Use the App only for lawful purposes
  • Not misuse, copy, scrape, or redistribute content without permission
  • Not interfere with the App’s technical operation or security

You may not use the App for commercial purposes unless explicitly authorized by us in writing.

4. Content and Intellectual Property

All content available through the Services, including the App, website, audio, text, images, branding, and software, is owned by or licensed to Walky Talky and protected by copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the App for personal use only.

5. Location-Based Features

The App may process your device’s location data in real time to enable walking tours or nearby audio content.

  • Location data is not stored, not tracked over time, and not used for profiling
  • Location access is optional and can be disabled via your device settings, but location access is needed for the best experience.

Safety Disclaimer

You are responsible for your own safety while using the App outdoors.

We are not liable for accidents, injuries, or damages occurring while walking, cycling, or otherwise moving during App use.

6. Tips, Donations, and Affiliate Marketing

Tips & Donations

The App is free to use. Users may voluntarily support us through tips or donations:

  • Tips/donations are voluntary and non-refundable
  • Payments are handled by third-party providers (e.g. App Store or payment processors)

Affiliate Marketing

The App may contain affiliate links or references:

  • We may earn a commission if you purchase via such links
  • Affiliate partnerships do not affect the price you pay
  • We are not responsible for third-party products or services

7. Privacy & GDPR

We process personal data in accordance with the EU General Data Protection Regulation (GDPR).

Key points:

  • Only data necessary to operate the App is processed
  • Location data is processed temporarily and not stored
  • We do not sell personal data

8. Third-Party Services

9. Disclaimer

We do not guarantee:

  • Continuous availability
  • Error-free operation
  • That content is always accurate or up to date

10. Limitation of Liability

To the maximum extent permitted by law, Walky Talky shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

Nothing in these Terms excludes liability that cannot be excluded under Dutch or EU law.

11. Termination

We may suspend or terminate access to the App at any time if you violate these Terms or misuse the App.

12. Changes to These Terms

We may update these Terms from time to time.

Continued use of the App after changes means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Netherlands.

Any disputes shall be submitted to the competent courts in the Netherlands.

14. Apple App Store Specific Terms

If you downloaded the App from Apple’s App Store:

  • These Terms are between you and Walky Talky, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide maintenance or support
  • Apple is a third-party beneficiary of these Terms and may enforce them

15. Google Play Specific Terms

If you downloaded the App from Google Play:

  • These Terms are between you and Walky Talky, not Google
  • Google has no responsibility for the App or its content
  • Google is not liable for any claims arising from your use of the App
